Privacy statement

Respecting your privacy

The Department of Transport and Main Roads is committed to protecting your privacy. We are bound by the Information Privacy Act 2009 (the IP Act) which regulates the way in which Queensland government agencies must manage personal information. It addresses concerns about any unauthorised use of this information and gives individuals a right of access to personal information held about them.

Personal information means any information about an identifiable living person. The IP Act defines personal information as information or an opinion, (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion

Our Information Privacy Plan takes into consideration the diverse range of activities and functions of the department and provides an overview of how we achieve compliance with the IP Act. The plan also provides a guideline for our employees and contractors who deal with personal information in relation to the functions and activities of the department.

Collection

We collect personal information about you in a number of different ways. This includes direct from you, for example, when you:

  • provide personal information to us
  • ask to receive updates from us
  • use our services
  • contact and correspond with us, for example, to ask for information or to ask for assistance through our call centre.

We may collect personal information that you choose to give us via online forms, email, subscribing to a Transport and Main Roads service, completing surveys or participating in other consultation and engagement activities, or engaging with us via social media.

We may also collect personal information about you from third parties. This will depend on the circumstances but may include the organisation that issues you with credentials that make you eligible for concession fares, and other government departments and third party service providers that provide criminal and other checks where relevant.

Generally, it is optional for you to provide your personal information. However, if we are not able to collect personal information about you, we may not be able to provide you with products, services and assistance to the extent that they require us to collect, use or disclose personal information.

When you visit this website

When you visit this website, our server makes a record of your visit and logs the following information for statistical purposes only:

  • the server address
  • date and time you visited the site
  • pages you visited and documents you downloaded
  • time spent on pages
  • the previous site visited
  • the type of browser you use
  • device screen size and type
  • region, country and preferred language settings.

Unless you provide your personal information as part of using the online services, we will not attempt to identify you or your browsing activities except in the unlikely event of an investigation, where a law enforcement agency may request inspection of the activity logs, through appropriate legal processes.

Cookies

Cookies are text files that a website can transfer to your computer when you access information on a site. Our websites may use cookies to retain preferences during your visit to our website for use next time you visit the site. Cookies used on our websites do not attempt to identify individual users.

Use and disclosure

The personal information we collect from you will generally be used only for the purposes:

  • you provided the information for
  • we have told you about in this Privacy Statement or in any terms or privacy notices specific to collecting that information
  • related to our functions and responsibilities.

We do not share personal information about you with other government agencies, organisations or anyone else unless one of the following applies:

  • you have consented
  • you’d expect us to, or we have told you we will in this Privacy Statement or in any terms or privacy notices specific to the collection of that information
  • it is required or authorised by law
  • it will prevent or lessen a serious and imminent threat to somebody’s life or health
  • the disclosure is reasonably necessary for law enforcement or for the protection of public revenue.

When you use online services

Our websites provide access to a wide range of online services. These include services enabling you to:

  • change your address and other details
  • access and manage information about your licences, registrations, authorisations, fines and infringements
  • participate in surveys or other consultation and engagement activities
  • interact with us via a Transport and Main Roads or Queensland Government (QGov) account.

When you use these online services, we will collect personal information about your use of the services and any information you provide as part of using the online services. We will use and disclose that information for the purposes of providing these services to you; for purposes identified in any terms or privacy notices specific to that service; and for the purposes and activities permitted by the IP Act and other applicable legislation. Your information will not be disclosed to any other third party without your consent, unless required or authorised by law.

For example: if you notify us of a change of address and/or e-contact details, this information will change the addresses recorded in the Transport Registration and Integrated Licensing System for your Queensland driver licence, marine licence, industry authority, adult proof of age card and/or vehicles or vessels registered in Queensland. All information recorded in the Transport Registration and Integrated Licensing System will be accessible by other entities as authorised by law, including the Queensland Police Service.

More specific information concerning some of our online services is set out below.

Driver licences

We collect the information you provide under the provisions of the Transport Operations (Road Use Management) Act 1995 and Transport Planning and Coordination Act 1994 so that you may apply for, replace or renew a Queensland driver licence or product, or complete a transaction. We may use this information in its communications with you and may disclose this information to interstate and overseas licensing authorities, and the Queensland Police Service. Your digital photo may also be released to the Queensland Police Service and the Australian Department of Home Affairs for national identity matching and verification purposes. Our card production contractor will have controlled access to your information, digitised signature and digital photo to make your card. Information, including your digital photo or digitised signature, may be disclosed to an authorised agency if the information is connected to an application for its product.

Registration

We collect the information you provide under the provisions of the Transport Operations (Road Use Management) Act 1995 and the Transport Operations (Marine Safety) Act 1994 so that you may apply for a registration product. Transport and Main Roads or our agents/contractors may use your information in communications with you and may disclose some of this information to vehicle/vessel insurers, statutory entities, insolvency entities, lawyers, persons involved in vehicle or vessel accidents and incidents, vehicle/vessel manufacturers, third parties who are involved in or intend to commence legal proceedings, tolling entities, law enforcement agencies and interstate registering authorities.

Accreditations

We collect the information you provide under the provisions of the Transport Operations (Road Use Management) Act 1995 when you apply for an accreditation product. We may use this information in communications with you and may disclose the information to interstate and federal authorities, and Queensland Police Service.

Booking entity authorisations

We collect information you provide when applying for booking entity authorisation under the authority of the Transport Operations (Passenger Transport) Act 1994. We will use the information you provide to assess your suitability to be granted and to continue to hold booking entity authorisation and to maintain a register of authorisations. We may use this information in communications with you and to monitor authorisations. Information such as your name and business name (if any), the name and business name (if any) of your local nominee (if applicable) and the number of the authorisation may be published on our websites. We may also disclose some of this information to the Queensland Police Service and interstate licensing authorities.

Booked hire service licences

We collect information you provide when applying for a booked hire service licence under the authority of the Transport Operations (Passenger Transport) Act 1994 and the Transport Operations (Road Use Management) Act 1995. We will use this information to assess your suitability to be issued and to continue to hold a booked hire service licence; and to maintain a register of licences. We may use this information in communications with you and to monitor licensing accreditation. Information such as the licence type, licence number and details of the vehicle stated in the licence may be published on our websites. We may also disclose some of this information to the Queensland Police Service and interstate licensing authorities.

Mobile applications

Any personal information that is collected or provided via a software application (App) will be collected, used and disclosed in accordance with the IP Act and any terms or privacy notices specific to that App.

Where relevant, we may record information about your use of the App. This information may include:

  • the random, auto-generated user account number created when the App is first launched and associated with your device
  • when and how you use the App
  • the pages you access, and the types of functions you use.

Emails and mobile phone/SMS device numbers

If you choose to supply an email address and/or mobile phone/SMS device number, you also consent to the use of that information for the following purposes:

  • issuing you with an online access code when you request it
  • responding to your enquiries
  • processing your transaction
  • sending you information, notices, reminders or updates on our products and services.

Email correspondence sent to this site will be managed in accordance with the Public Records Act 2002.

Email messages may be monitored by our web team for system troubleshooting and maintenance purposes.

Use of de-identified information

We may aggregate, anonymise or otherwise de-identify your personal information (so that it can no longer be associated with you) for analytics, research or statistical purposes, and for the purposes of improving our services and systems. We may use such de-identified information indefinitely without further notice to you.

Access, amendment and deletion

You have a right to request access to and amendment of personal information held by us and may also use our online services and Apps to access, update and amend some personal information.

You may also ask us to delete:

  • accounts created using Transport and Main Roads Apple or Android Apps
  • information held by us associated with those accounts or with any Transport and Main Roads online service or App integrated or connected with Meta products including Facebook.

If you wish to access, correct or update any personal information we may hold about you, or ask us to delete an account or information associated with a Transport and Main Roads App or Meta product as described under third-party login providers:

  • use the relevant online service or App on our websites
  • contact our call centre on 13 23 80 or a Transport and motoring service centre. For TransLink related enquiries, contact TransLink on 13 12 30.

We may decline to provide access to, amend or delete information where we are legally permitted to refuse to do so. We will explain the basis for our decision when responding to your request or otherwise within a reasonable time.

Security

We take all reasonable steps to keep personal information we hold about you secure and protected against loss, misuse and unauthorised access. However, this site does not provide facilities for securely transmitting information across the Internet.

We operate an Information Security Management System that conforms with the requirements of the Queensland Government Information Security Policy and International Information Security Standard (ISO/IEC 27001:2013).

The Information Security Management System includes information security controls that have been implemented to provide a secure environment. Employees are made aware and regularly reminded of our privacy obligations and our commitment to keeping personal information we hold secure. We securely encrypt the transmission of information across the internet by using Transport Layer Security.

Privacy complaints

If you believe that we have not dealt with your personal information according to the IPPs contained in the IP Act, you may lodge an information privacy complaint.

A privacy complaint is a complaint by an individual about an act or practice of a department in relation to the individual’s personal information.

Privacy complaints made to us must:

  • be in writing
  • state an address of the complainant to which notices may be forwarded under the IP Act
  • provide certified identification
  • give particulars of the act or practice the subject of the complaint.
